Removing 16 + 17 Year Olds Off Rikers

The 2017 Raise the Age legislation mandates that all 16 and 17 year old incarcerated youths can no longer be housed in adult detention facilities. A special carve out in the law for New York City requires that by October 1, 2018, these youths be removed off of Rikers Island and housed in specialized secure juvenile detention facilities operated by ACS in conjunction with DOC. Currently, there are approximately 110 youths on Rikers Island who would need to be moved to ACS facilities in October 2018.

The spirt of the new Raise the Age legislation makes sense in terms of supervising adolescent detainees in a more appropriate setting.

However, in light of the numerous legal and safety issues that have arisen since the legislation was enacted, it is evident that the City of New York is woefully unprepared to provide the required juvenile facilities and optimal levels of security in housing these detainees, in ensuring they receive necessary programs, and in ensuring their safe transportation to and from the courts.

Extend the Date to April 2019
